CONSTRUCTION ACCESS CONSENT TO ENTER AND WAIVER OF TRESPASS AGREEMENT

KNOW TO ALL MEN BY THESE PRESENTS:

THIS AGREEMENT, made and entered into this ______ day of ________________________, 20___, by and between Party A (hereinafter referred to as "Grantor") and Party B (hereinafter referred to as "Grantee").

RECITALS

1. Grantor is vested in fee simple title to a tract of land situated in ___________________ County, Minnesota, and legally described as follows, to-wit:

See attached Exhibit "A" (Legal Easement Description)

2. Grantee wishes to install certain stormwater improvement devices on the property owned by Grantor described in attached Exhibit "A."

In consideration of the mutual covenants herein stated, the parties agree as follows:

a. Grantor hereby grants to Grantee the right and privilege to enter on the above described land for purposes of installing and maintaining the previously described stormwater features. The Grantor also grants to the Grantee the right to perform long term monitoring and maintenance on these stormwater features.

b. Grantor agrees to waive any claim for damages or trespass against the Grantee as a result of the work described above.

c. Grantee hereby agrees to restore the property to its original condition after installation of the stormwater improvement devices; said site restoration work to be paid exclusively by the Grantee.
